Easy come, easy go
Many of you know that we had sold our house, and had intended on moving tomorrow.
We were informed today that our contract has fallen through due to the buyer not getting approved for financing from his lender. This is what I have been explained that has happened, although by the time I hear something it has gone through several people before I get an answer.
The buyer, who was relocating from out of town, was told he had a job in our area. (We did not know he didn't already have a local job here.) He put a contract on our house, we have been busy packing and preparing for a move. His job fell through and the lender would not approve him for the loan.
Apparently, for a FHA loan, there is a stipulation that you must work in the same town in which you live. He is no longer approved for this loan because living here is far enough from his job in his hometown and would present an unreasonable daily commute.
The buyer wants to back out of the contract because he no longer has a job in our area. The problem is, we were never told that could even be a possibility. There was never a conversation or contingency in the contract that stated he could possibly back out if he didn't get the job. We would have never accepted his offer if we had known this. We thought he was serious since he had a pre-approval from a reputable company. Of course, he could try to obtain a different type of loan, or a different lender to buy our house. He still qualifies financially for it. However, who would want to buy a house that would have them travelling four plus hours to work every day. We aren't hopeful that's going to happen.
The other problem is there is some debate on rather we are eligible for the earnest money. From what we understand the buyer wants it back (because who doesn't want money.) I'm sure he feels that it wasn't his fault he didn't get a job. Of course, we feel we are entitled to it as we have accrued expenses on the house for repairs at their request, moving expenses, as well as wasted almost 2 months to go back on the market on Monday to start the entire process over. It certainly wasn't our fault he entered into a contract without making sure he would have a job in that new location.
We have been told by our realtor, that because the buyer was so far into the process, and is backing out for something that we were never informed, that we are legally able to pursue forcing him to close. We have decided that if he will release the earnest money to cover our expenses we will let him out of the contract and try to move forward with a new buyer. If they fight us about the earnest money, we may have to seek mediation, which is no good for anyone.
So for the time being, we are going to stay with my very generous parents. They are opening up their home to us & our two busy kids. We have decided to move our packed boxes to the storage we already rented, and stage the house with the remaining furniture. We are going back on the market for 30 days, and if we obtain a contract in that time we'll continue with a move. If not, it looks like we'll be moving back into our house.
So that's the scoop.

Texas Caviar
Texas Caviar
I got this recipe from a mom at the school I used to teach. It's a good dip to serve with fritos or tostito chips.
Chill 2 hours covered.
15 oz. can black beans
15 oz can pinto beans
15 oz can black-eyed peas
1 can white shoepeg corn
1-2 jalapeno peppers, diced
1 red pepper, diced
1 green pepper, diced
1 med. red onion, diced
fresh cilantro to taste
Marinade opt 1: (Good, but very sweet)
3/4 cup apple cider vinegar
1/4 cup vegetable oil
1 cup sugar*
1 tspn salt
1/4 tsp ground pepper
1 tbsp water
(* this is very sweet, I'd recommend starting with less sugar and adding to your likeness)
Put all ingredients together, mix well until sugar dissolves, and then pour over bean mixture.
Marinade opt 2: (zesty)
Use Zesty Italian dressing instead.
Directions:
- Drain & rinse beans & corn in colander
- Pour beans & diced vegetables in a bowl with a lid.
- Mix & pour marinade over the top.
- Cover and let mixture marinade in fridge for at least 2 hours.
- Serve with fritos or tostitos.

Now that's Customer Service
Wow, it's rare that you get great customer service! Our kitchen faucet has been leaking due to a hairline crack that has formed under the faucet sprayer head. Whenever we turn on the water a second stream starts dripping out into the sink & down the base of the faucet. It's completely functional, but occasionally I burn my hands from the hot water that drips when I washing dishes. A little annoying.
Since we are selling our house, I felt like I needed to fix this. The cheapest faucet I could find in a similar style was on clearance for $84. That's kind of pricey since we are only planning on living here about another month.
While I was at Home Depot today the HD guy asked me what kind of faucet I currently have. It's one by Price Pfister. He told me to call because all of their products have lifetime warranties. Since this was installed by our home's builder 6 years ago, I didn't have any kind of receipt or warranty paperwork. I was sure they wouldn't be able to help, but I was pleasantly surprised when I emailed customer service.
The company sincerely apologized for the problem and are sending me out a replacement part, for free. I only have to pay $5 for shipping. Since I was looking at paying a lot more for a new faucet, I am thrilled to pay only $5. I was really surprised that I didn't get hasseled about not having paperwork or receipts. They didn't even ask me for it. Wow!

Lesson Learned
So this morning, Adam has been particularly in a foul mood. I am met with opposition every time I ask him to pick up a toy, or his dirty underwear off the floor.
He whines, cries, followed by a long argument of "why, does he have to do it?" Usually there is an explanation that someone else played with it, or he was still going to wear that particular item of clothing, so he should be left alone to enjoy his Power Rangers movie for the 32nd time.
This morning, as Adam was eating his breakfast, I was washing dishes. I realized how unfair it is for me to have to wash bottles I don't drink from, as well as specialty plates designed for children that I don't use.
On purpose, I threw a ridiculous fit. I stomped my feet, I whined, I cried. I stated my case on the injustice of it all. I asked, to a surprised 5 year old, "Why do I have to clean this mess, I didn't make it?! It's not fair!!" I threw in an extra "Whaaaa!" for good measure.
He responded, "It is fair, because when you do service for others it makes you happy inside."
He's right. I plan on telling him exactly that next time he complains about helping out.
